Introduction
Phone Maverick is a Canadian company that provides digital home & business phone services (local and long distance) to customers in Canada.
We know that the protection of your privacy is important to you At Phone Maverick, we want to make your experience satisfying and secure. Your information is kept confidential and used only for the purposes for which it was collected. We are compliant with federal legislation that has been designed to protect you and your personal information. Our privacy policy is based on the 10 standard Privacy Principles included in Schedule 1 of the Personal Information Protection and Electronic Documents Act, also referred to as “PIPEDA” and the rules established by the Canadian Radio-Television and Telecommunications Commission.
Phone Maverick is active in ensuring that your personal information is protected against unauthorized access or misuse. We do not sell your personal information and we do not disclose your information except to provide you with service or as may be required by law. Any time we must provide information to a third party, we only do so in accordance with our stated policies and we do our best to ensure that it is afforded an equivalent level of protection as that offered by PIPEDA.
Phone Maverick will continue to review the Privacy Policy at least every five years to make sure it is relevant and remains current with changing technologies, standards, customer concerns, rules and regulations, and laws.
Personal Information
When used in this Policy, and consistent with the PIPEDA, personal information means any information about an identifiable individual. This would include information respecting your account with us, including your identity and the services you use and subscribe to, as well as credit information, billing records and any complaints documented in a file. Personal information that is aggregated and cannot be associated with an identifiable individual is not considered to be personal information.
Examples of this type of information may include, but is not limited to:
Names, addresses (including email), telephone numbers, age, date of birth.
Social Insurance Number, credit card or bank account numbers, credit, billing or call history.
Identifiers* (account number, order numbers, services, IP Addresses, MAC addresses, usernames, passwords, configurations, security questions and answers).
Opinions, evaluations, comments, disputes, intentions, activities or meta-data.
* Phone Maverick retains ownership of any identifiers provided to the Customer in association with the Service.
Principle 1 – Accountability
Phone Maverick is responsible for personal information under its control including information that has been transferred to a third party for processing and has designated a privacy officer to respond to any complaints or inquiries with regards to how we use your personal information. They are responsible for overseeing our compliance with PIPEDA. All employees are trained to follow our policy and procedures.

Principle 2 – Indentifying Purposes
Phone Maverick identifies the purposes for which personal information is collected at or before the time the information is collected.
Phone Maverick collects personal information only for the following purposes:
Unless required by law, Phone Maverick shall not use or disclose, for any new purpose, personal information that has been collected without first identifying and documenting the new purpose ans obtaining the consent of the customer or employee.
Principle 3 – Consent
In general, the use of Phone Maverick products and services constitutes implied consent to the collection, use and disclosure of personal information (such as, but not limited to, your name, phone number, address, and billing information) as set out in this Policy.
We will obtain your express consent prior to using or disclosing your personal information for a purpose that is not described within this privacy policy, or that we did not identify to you at the time of collection.
When dealing with certain legal, medical, or security issues, Phone Maverick may be required by law to disclose your personal information without seeking or obtaining your consent.
We may also collect, use or disclose personal information without knowledge or consent if seeking the consent of the individual might defeat the purpose of collecting the information such as in the investigation of a breach of an agreement or a contravention of a federal or provincial law.
Phone Maverick may disclose personal information without knowledge or consent to a lawyer representing the Phone Maverick, to collect a debt, to comply with a subpoena, warrant or other court order, or as may be otherwise required by law.
Consent may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice; however, without such consent, Phone Maverick may no longer be able to provide the customer with all products and services. Customers may contact Phone Maverick for information on the implications of withdrawing consent.
Principle 4 – Limiting Collection
Phone Maverick shall limit the collection of personal information to the amount necessary to carry out the identified purpose(s). Phone Maverick shall collect personal information by fair and lawful means, and will be generally collected directly from the indivicual concerned. At the time of collection, our representative will explain why the information is needed.
Phone Maverick may also obtain credit information on a confidential basis from credit evaluation organizations; however, prior consent will be obtained from customers before performing a credit evaluation.
Principle 5 – Limiting Use, Disclosure, and Rentention
Phone Maverick shall not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required by law. We shall retain personal information only as long as necessary for the fulfillment of those purposes.
As noted in Principle 3, in certain circumstances, personal information may be collected, used or disclosed without the knowledge or consent of the individual concerned. In addition, Phone Maverick may disclose a customer’s information to:
Any such disclosures are made on a confidential basis, with the information to be used only for the intended purpose.
Personal information that has been used to make a decision about an individual will be retained long enough to allow that individual to have reasonable access to the information after the decision has been made.
Personal information that is no longer required to fulfil the identified purposes will be destroyed, erased or made anonymous.
The fact that you are a Phone Maverick customer may be revealed to other potential or existing Phone Maverick customers.
Principle 6 – Accuracy
Keeping in mind the purpose of its use, we will make every reasonable effort to keep your personal information as accurate, complete, and up-to-date as possible. This is done to minimize the possibility that inappropriate information may be used to make a decision about an individual.
Phone Maverick will update personal information as and when necessary to fulfil the identified purposes, or when requested by the individual in question.
Principle 7 – Safeguards
Phone Maverick will ensure that your personal information is protected against such risks as unauthorized access, loss or theft, copying, disclosure, modification or destruction and any other type of misuse, by maintaining industry standard security safeguards. Methods of protection include physical, operational, and technical measures, as required and appropriate.
Excluding when they are in use by authorized personnel, paper-based files containing personal information are secured within a restricted area. Electronic data containing personal information is restricted to authorized users only.
Phone Maverick will protect personal information disclosed to third parties by contractual agreements requiring that those third parties adhere to confidentiality and security procedures and protections that are, at a minimum, equivalent to those employed by Phone Maverick itself.
Principle 8 – Openness
We encourage you to read our privacy policy and shall make it available to customers and employees. If you are not able to print a hard copy from our website, we will gladly mail one to you. If you wish to discuss the policy, please contact us via phone, e-mail, or mail as outlined in Principle 1.
Principle 9 – Individual Access
You are entitled to have access to your personal information. Upon your written request, Phone Maverick will promptly inform you of the existence, use, or disclosure of your personal information, except as proscribed by law.
In some exception and limited circumstances, if the information you requested is too costly to collect or if it conflicts with any legal or commercial proprietary obligations, Phone Maverick may withhold access or charge a reasonable fee. In the event that we do withhold access, you will be notified of the reason(s) no later than 14 days after your request was submitted.
You may challenge the accuracy of the information under our care, and have it amended when appropriate.
A customer may obtain access to his or her personal information by contacting Phone Maverick using the contact information provided in this Policy.
Principle 10 – Challenging Compliance
A customer is able to address a challenge concerning compliance with the above principles to the designated individual or individuals accountable for Phone Maverick’s compliance with this Policy (see Principle 1).
Phone Maverick has procedures in place to receive and respond to complaints or inquiries about our policies and practices relating to the handling of personal information, and will inform individuals who make inquiries or complaints about the relevant complaint procedures.
The company shall investigate all complaints. If a complaint is found to be justified, COGECO will take appropriate measures, including, if necessary, amending its policies and practices.

Because we gather certain types of information about our customers online, we feel you should fully understand our policy and the terms and conditions surrounding the capture and use of that information. This privacy statement discloses what information we gather and how we use it.
Information we gather and track
Phone Maverick gathers two types of information about users:
Information that users provide through optional, voluntary submissions. These are voluntary submissions to receive our electronic newsletters, to refer a friend, and from participation in polls and surveys or to order any service:
Information Phone Maverick gathers through aggregated tracking information derived mainly by tallying page views throughout our sites. Under no circumstances does Phone Maverick divulge any information about an individual user to a third party except to its partner companies.
We Gather User Information In The Following Processes:
Optional Voluntary Information
We offer services, which require some type of voluntary submission of personal information by users:
1. Electronic newsletters policy (Dispatches)
We will offer a free electronic newsletter to potential and existing customers. Phone Maverick gathers the email addresses of users who voluntarily subscribe to this service.
2. “Refer a friend” policy
Our site’s users can choose to refer a friend to Phone Maverick by voluntarily providing us with their e-mail address, as well as that of the recipient. This information is used only in the case of transmission errors and, of course, to let the recipient know who sent the email. The information is not used for any other purpose.
3. Polling
We may offer interactive polls to users so they can easily share their opinions with other users and see what our audience thinks about important issues. Opinions or other responses to polls are aggregated and are not identifiable to any particular user. Phone Maverick may use a system to “tag” users after they have voted, so they can vote only once on a particular question. This tag is not correlated with information about individual users.
4. Surveys
Phone Maverick may occasionally conduct user surveys to better target our services to our audience. We sometimes share the aggregated demographic information in these surveys with our partner companies. We never share any of this information about specific individuals with any other third party.
Usage Tracking
Phone Maverick tracks user traffic patterns throughout all of our sites. However, we do not correlate this information with data about individual users. Phone Maverick does break down overall usage statistics according to a user’s domain name, browser type, and MIME type by reading this information from the browser string (information contained in every user’s browser).
Phone Maverick sometimes tracks and catalogs the search terms that users enter in our Search function, but this tracking is never associated with individual users. We use tracking information to determine which areas of our sites users like and don’t like based on traffic to those areas. We do not track what individual users read, but rather how well each page performs overall. This helps us continue to build a better service for you.
We may place a text file called a “cookie” in the browser files of your computer. Cookies are small files that a site or its service provider transfers to your computer hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information. The cookie itself does not contain Personal Information although it will enable us to relate your use of this site to information that you have specifically and knowingly provided. But the only personal information a cookie can contain is information you supply yourself. A cookie can’t read data off your hard disk or read cookie files created by other sites. Phone Maverick uses cookies to track user traffic patterns (as described above). Our advertising system delivers a one-time cookie to better track ad impressions and click rates.
You can refuse cookies by turning them off in your browser. If you’ve set your browser to warn you before accepting cookies, you will receive the warning message with each cookie. You do not need to have cookies turned on to use this site. However, you do need cookies to participate actively in message boards, forums, polling and surveys. Each browser is a little different, so look at your browser's Help menu to learn the correct way to modify your cookies.
If you disable cookies, some features will be disabled that make your site experience more efficient and some of our services will not function properly. However, you can still place orders .
Phone Maverick uses any information voluntarily given by our users to enhance their experience with our service, whether to provide interactive or personalized elements on the sites or to better prepare future services.
As stated above, we use information that users voluntarily provide in order to send out electronic newsletters and to enable users to participate in polls and surveys. We send out newsletters to subscribers on a regular schedule (depending on the newsletter), and occasionally send out special editions when we think subscribers might be particularly interested in something we are doing. Phone Maverick never shares newsletter mailing lists with any third parties, including advertisers or sponsors, except with partner companies.
Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
Canada's Anti-Spam Legislation (CASL)
We have taken the necessary steps to ensure that we are compliant with the CASL by never sending out information to those who do not want it.
By using this site, you consent to the collection and use of this information by Phone Maverick. If we decide to change our privacy policy, we will post those changes on this page, and/or update the Privacy Policy modification date below. Policy changes will apply only to information collected after the date of the change.
